Identity Theft, How Business Owners Can Protect Themselves

Identity theft has become such a serious problem to Americans and business owners are losing so much money to identity thieves that state and local governments have stepped in by passing many laws that actually have a potential negative impact to the business. Unfortunately 87% of owners are unaware that non complianace with these laws could cost them personally or their business up to $1million in fines and up to 10 years in prison. Federal legislation as well as many state laws require business owners to secure all personal information (social security numbers, driver's license numbers, credit card numbers, date of birth, etc.) of their clients and employees. Non compliance could result in closing the business, fines, penalties, criminal and civil litigation. Identity Theft issues are expected to be THE next hot class action target.

Disgruntled workers with access to their employer's data files can make a lot of money selling little pieces of you. They can sell your Social Security number Identity for $100, they can sell your credit card info (financial identity) and they can also sell your driver's license identity which will have a negative impact on your character/criminal identity if they decide to rob a liquor store and get caught with "your" driver's license. You already know about the dangers of medical identity theft if you saw any of the 3 Reader's Digest covers from 2006.

The Feds recently decided that the DMVs of each state needed to be able to recognize what the actual driver's licenses of all other states looked like. The Feds made up a little book with the EXACT specifications on each state's driver's license. About a week after that book was distributed, it was already being sold on the internet. A new and lucrative business has sprung up because of that book. All a criminal needs is a computer, printer, laminator and that book to have a prosperous criminal enterprise. Even trained authorities can't tell the difference between a "real" and fake license"real" license and the fake one. In fact they can't tell the difference between the "data base you" and the you who is looking at yourself in the mirror. The data base you has gone on a crime spree and given the police a copy of a driver's license with YOUR number and another address on it. You never get the notice to appear and they sure aren't going to show up at your trail, so a bench warrant goes out in your name. The next time you are stopped for some routine traffic violation, the real you is going to jail. How many times do the criminals say, "OK, you got me." Isn't the regular drill something like, "You've got the wrong guy. It wasn't me." Except this time it WAS the data based you.

Only one in 700 criminals engaged in ID theft are caught. This crime wave has no end in sight. Employee absenteeism can really hurt the bottom line. The Federal Trade Commission estimates it takes 600 hours to restore your identity. That is 15 40 hour work weeks. Who has that kind of time? ALL the data leaks are coming from ignorance on the part of businesses or the government themselves. The Census Bureau is very proud that they have ONLY lost 1,200 lap top computers with millions of names and personal information on American citizens. Because the government can't do anything on the criminal front, they are clamping down on businesses.

The National Institute of Standards and Technology (NIST) identifies "unauthorized access" as a type of security breach that each business must address. That means each computer needs to be password protected and the password can't be put on a yellow sticky on the monitor. You need a clean desk policy at the end of each business day with ALL personal information locked up.

ID theft crime rings have set up "janitorial" businesses that come in at night and copy client and employee data files, go through unlocked file cabinets and trash looking for personal info, employment applications etc. Confidence men (women) can take jobs as low level temporary office employees and steal the data bases with all the information of the businesses clients.

In "The Coming Pandemic" (5/15/06 article in Chief Information Officer magazine) the writer says, "If you experience a security breach, 20% of your affected customer base will no longer do business with you. 40% will consider ending their relationship, and 5% will be hiring lawyers!" The author also stated, "When it comes to cleaning up this mess, companies on average spend 1,600 work hours per incident at a cost of $40,000 to $92,000 per victim."

Here is an outline of the major laws that affect ID Theft and have led to absolute liability to businesses that have not secured their files.

ID Theft was finally recognized as a crime in 1998 when Congress passed the Identity Theft and Assumption Act and established the Federal Trade Commission as the lead agency to enforce and fine businesses for non compliance. The FTC says that each year since 1998 there has been twice as much ID theft reported than the year before and even though it is severely under reported it is estimated that as of July 2006 there have been over 88 million consumers affected by the reported breaches.

FACTA (Federal legislation in effect since June 2005) Grants additional rights to consumers and incorporates specific provisions designed to help victims of ID theft and fraud, mainly that they are entitled to one free credit report per year from each of the 3 reporting agencies due to the proliferation of ID theft that has only gotten worse. Gramm, Leach, Bliley Safeguard Rule (fed legislation since 1999) the compliance deadline was in 2001 GLB, has a broad spectrum of qualifications, requirements and regulating parties. Eight agencies and the states are charged with managing and enforcing the regulations.

GLB applies to a broad range of businesses that collect the personal financial information of their clients.The two regulations of GLB are the Financial Privacy Rule and the Safeguards Rule. The Financial Privacy Rule addresses the collection and dissemination of customers' information while the Safeguard rule governs the processes and controls an organization's uses to protect customers' financial information.

The Safeguard Rule is enforced by the FTC. In addition to public embarrassment of non-compliance, organizations may be fined thousands of dollars a day while they are non-compliant.

GLB calls for businesses to:
1. Ensure the security and confidentiality of customer information;
2. Protect against any anticipated threats or hazards to the security or integrity of such information; and
3. Protect against unauthorized access to or use of such information that could result in substantial harm or inconvenience to any customer.

In a nutshell, it requires that regulated companies do the following: Specify a person or group of people to be responsible for GLB compliance. Identify security risks involving customer information. Assess existing safeguards for protecting the privacy of customer information. Implement any additional safeguards that are needed. Monitor the effectiveness of safeguards. Ensure that service providers are able to meet the GLB requirements. Upgrade the organization's security program as necessary due to changing circumstances.

California SB 1386, effective 7/1/03 Data Breach Notifications ANY business having even 1 customer in California requires a PUBLIC disclosure of computer security breaches when personal information of any California customer is compromised. This law subjects a company to civil and class action lawsuits by any injured customer.

Betty Broder, who is the assistant director of the FTC's Division of Privacy and Identity Protection says, "You don't have to have a perfect plan, but you MUST have a written plan describing how customer and employee data will be protected and an officer on staff responsible for implementing that plan. We need to see that you've taken reasonable steps to protect your customer's info." (quote taken from American Bar Association 3/06 story, "Stolen Lives")

The 1/19/06 edition of Business and Legal Reports says, "One solution that provides an affirmative defense against potential fines, fees, and lawsuits is to offer some sort of identity theft protection as an employee benefit. An employer can choose whether or not to pay for this benefit. The key is to make the protection available, and have a mandatory employee meeting on identity theft and the protection you are making available, similar to what most employers do for health insurance..."

By having a mandatory meeting the employees finally understand their responsibilities to protect the sensitive data of your client's business. This may be overwhelming BUT with a little help a business can develop an affirmative defense. Finding Hidden Assets

If you have a judgment against an individual, most likely you are not going to find any attachable assets by searching public records. Judgment debtors are smart. They know you are looking for their bank accounts. Most of them do not have open checking/savings accounts in their name.

In recent years, the internet has been a great place to hide money. PayPal for example allows individuals to have online accounts to either store funds or make business transactions. A high percentage of Ebay users have PayPal accounts. Many online businesses use PayPal as a form of accepting credit cards. If you believe your debtor has a PayPal account, here is what you do:

Have your attorney send a letter via U.S. Certified Mail or by courier service (Fed Ex, UPS, etc..) to PayPal with a subpoena (or writ of attachment if you have a judgment) to the following address:

Make sure the subpoena/writ includes the debtors full name, address, social security number. It wouldn't hurt to include the email address of the debtor.

Another way to search for someone assets is to check their trash. I always tell my clients to shread their personal information before they throw it away. However, there are still many careless people out there who just throw away their bank statements, stock portfolio, telephone bills, etc...

In most cities it is legal to search through someone's trash as long as the containers are on the street or in the alleyway. I suggest checking with the city regarding their laws before you take someone's garbage.

There are many other creative ways to find hidden assets. I won't list them all here. The above steps are probably the best way to start when you need to collect on a sizable judgment.

Ginger is also reputed to help relieve nausea, motion sickness, dizziness, flatulence and even help to ease muscle pain.

To properly make herbal tea, use 1 tea bag per person or, if you are making it from the dried herbs, use 1 teaspoon of the herb. Add boiling water to the herb mixture and let sit for 5 minutes. Dont let it sit for too long or it will start to taste bitter. Dont drink it too soon or the herb wont have imparted its flavor into the water enough. Typically herbal teas are taken black but you could add a little milk or some sugar or honey to taste if you like.

When somebody says yes, then you should contact a lawyer to do the contracts etc. This you shouldnt do on your own. It is important to avoid any legally complications, as this demands a lot of unnessesary energi.

Selecting The Right Hawaii Mediator

As most Hawaii Attorneys know, mediation has become a very effective litigation tool in Hawaii. Although mediation is practiced throughout the United States, the people of Hawaii, with their unique cultural history, seem particularly well-equipped to effectively use mediation. Although I was trained to practice law in New York, I moved to Hawaii in 1993. I have personally observed that Hawaii has a strong preference to mediation and that some of our finest jurists actively participate in this process.

For those unfamiliar with this practice, Mediation is a device in which parties to a dispute agree on an impartial third person who guides the litigants to a settlement using various negotiation and/or communication techniques. Although Mediation may serve several purposes, the overall goal is to assist the parties to find a way to solve their own problems.

The selection of the mediator is critical. Parties should look for the following factors in a mediator:

1. The mediator has no conflict of interest. Obviously, if the mediation is to succeed, the litigants have to be able to rely that the mediator is completely unbiased and is attempting to guide them to a fair resolution of their dispute.

2. The mediator has adequate time to devote to the case. In Honolulu, some of the most talented mediators must be retained months in advance. If the potential mediator does not have time to devote to your case, find another mediator.

3. The mediator should be able to meet the parties expectations with regard to timing. Some cases absolutely must be resolved immediately. Counsel should take this into consideration when selecting a mediator.

4. The mediator should be completely candid and honest with all aspects of the process. If the potential mediator neglects to tell you about an important conflict until the mediation has begun, you may need a new mediator.

5. The mediator must be qualified. The goal is to settle the dispute. It does not necessarily aid the process if the mediator is a friend of all of the lawyers. The mediator does not have to be your friend. His or her job is simply to find a way to settle your case.

Finally, the litigants should understand that if a mediation is to be successful, they must be willing to compromise. If you want to "crush" your opponent, you won't do it in a mediation. If you are not prepared to compromise, you may not be ready to mediate.

Obesity and Birth Control Pills

The first face - The failure of birth control pills

A recent study has found that overweight or obesity increases the chances of pregnancy while using birth control pills. Gynecologists say that birth control pills (also known as oral contraceptives) have not enough effect on overweight or obese women. Overweight (BMI 25 to 29.9) women have 60% and obese (BMI 30 or more) women have 70% more chances of pregnancy than normal weight (BMI 18.5 to 24.9) women while taking oral contraceptives regularly. For women who missed oral contraceptive, the risk of pregnancy more than doubled compare to overweight or obese women. Study says that out of hundred overweight women taking the oral contraceptives, five got pregnant while only three out of hundred normal weight women who take oral contraceptives got pregnant each year.

The reason of failure of oral contraceptives is not clearly known. This is a big research area. They said there are several possibilities for failure of oral contraceptives in obese women.

The hormones in oral contraceptives are soluble in fat which is in enough quantity in obese women. Due to this, fat hormones dissolve in fat rather than entering the bloodstream.

Metabolism is also a major cause. The basal metabolic rate increases according to body weight; more the body weight, more basal metabolic rate. The increase in metabolic rate decreases the duration of medication effect. This is the also one of the causes due to which oral contraceptives do not work.

Due to obesity, there is an increase in liver enzymes which help metabolize the hormones in oral contraceptives.

Nowadays the hormones level in oral contraceptives is reduced by five times than first introduced.

Circulating blood volume in obese women is greater than normal women in which the steroids are transported. Fat cells may sequester steroids. Obese women also metabolize steroids in different way than normal one.

Now the real question arises. Should overweight women who dont want to risk an unplanned pregnancy should take more oral contraceptives or higher dose oral contraceptives or not? Gynecologists say it is not necessarily because overweight or obese women have more chances of cardiovascular disease risk factors than normal weight women. They suggest that obese women who completed childbearing use some permanent form of birth control such as tubal sterilization.

Obese women who want to be pregnant may use condom or other methods. Another method for obese women suggests that first they should lose their weight, and then plan to use oral contraceptives. For weight loss, obese women can use weight loss diet pills, natural supplements, exercise, yoga and other weight loss programs. Through exercise losing weight takes more time which is not considerable for women. For quick weight loss they can use weight loss diet pills.

The second face- Birth control pills- Reason of Obesity

Gynecologists say that birth control pills (oral contraceptives) may have many side effects; one of them is weight gain or obesity. Most of the women get five pounds weight after taking oral contraceptives. Normally women get weight after few days or a month from starting of taking the pills. In most of the cases, women gain weight who do not take oral contraceptives in the last half of their menstrual cycle; this is due to hormonal changes. This is also important to know why women get obese by taking oral contraceptives. Reasons for this are as follows.

Due to oral contraceptives, the level of metabolism alters. This is because both the estrogen and progestin present in these pills can cause fluid retention, a temporary effect that often begins in the first month as a result of an increase in sodium. The cause of weight gain (increase of hips, breast, or thigh) is due to estrogen.

Oral contraceptives contain progestin which cause increase in appetite and permanent weight gain.

Pills administered for depression may also be the cause of weight gain.

Women who get weight due to oral contraceptives may loose weight through weight loss diet pills, natural supplements, exercise, yoga and other weight loss programs.

One Dayer Cricket Bowler Rankings 2006 (All Teams)

Varaiya of Kenya was the best One Day Bowler in 2006!! Wow! He took a phenomenal 12 wickets in just 6 matches he played, at a miserly economy rate of 3.15 RPO and an average of 13.5 RPW taking a wicket every 25.6 balls he bowled. 1. Brisbane:There is so much to do in Queenslands capital city. Visit the Alma Park Zoo, picnic and swim at Southbank Parklands or view the city and coastal region from Mt Cootha lookout. Hastings Street is the place to be for stylish shopping and beach side restaurants, and head to the Noosa River for all types of water sports, fishing and boating activities.

6. Montville:Located in the Sunshine Hinterland, this area is popular for weekend retreats and day trips.
